Welcome to Sees Journal (“the Site,” “we,” “us”), an independent, free editorial guide to visual art and theater in San Diego, California. By accessing or using the Site in any way — browsing listings, viewing the map or Atlas, using the “Open Now” feature, saving shows, subscribing, or submitting information — you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, do not use the Site. Your continued use of the Site after any change to these Terms constitutes acceptance of the revised Terms.
The Site aggregates and summarizes publicly available information about exhibitions, events, performances, venues, addresses, hours, and dates. This information is collected largely by automated means, changes constantly, and may be incomplete, outdated, or wrong. Exhibitions close early, events are cancelled or rescheduled, venues move, hours change without notice, and features such as “Open Now,” “Opening,” “Closing,” “Now Playing,” and mapped locations are best-effort estimates, not promises.
You are solely responsible for confirming all details directly with the venue or organizer before making plans, traveling, or purchasing anything. We do not guarantee that any listed event exists, will occur, or will match its description, and we accept no responsibility for wasted trips, closed doors, cancelled events, incorrect prices, or any other consequence of relying on information on the Site.
Nothing on the Site is legal, financial, investment, safety, travel, or other professional advice. Editorial descriptions, picks, ratings, and essays are subjective opinion offered for general interest only.
The Site links to and describes venues, organizers, ticket sellers, and other third parties that we do not own, operate, control, or endorse. Any visit you make to a physical venue, any event you attend, and any transaction you enter — including tickets, admission, memberships, donations, parking, or purchases — is solely between you and that third party, on that third party’s terms. We are not a party to, and accept no liability arising from, any such visit, event, or transaction, including personal injury, property damage or loss, refunds, or disputes of any kind.
Linked websites have their own terms and privacy practices; we are not responsible for their content, accuracy, security, or availability. Images, names, titles, trademarks, and other materials belonging to venues, artists, and organizers remain the property of their respective owners and appear on the Site for informational and editorial purposes to describe and direct visitors to the works and venues concerned; such use does not imply affiliation, sponsorship, or endorsement in either direction.
Attending physical venues and events carries inherent risks. To the maximum extent permitted by law, you assume all risks associated with visiting any venue or event discovered through the Site, and you release us from any claim arising out of or connected with any such visit or attendance.
The Site’s original content — including its editorial text, curation, design, and code — is owned by Sees Journal and protected by applicable law. You may view and share links to the Site freely for personal, non-commercial use; you may not scrape, republish, or exploit the Site’s content commercially without written permission.
We respect the intellectual property of others. If you believe any material on the Site infringes your copyright or should be removed or credited differently, contact us through the contact page with the URL and details, and we will review and respond promptly, including removal where appropriate. This is also the designated route for notices under the Digital Millennium Copyright Act (17 U.S.C. § 512).
If you send us information — a missing venue, an event, a correction, or any other material — you represent that you have the right to share it and that it is accurate to your knowledge, and you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, edit, publish, and distribute it in connection with the Site, with or without attribution. Do not send confidential or proprietary information; submissions are not confidential. We may use, decline, or remove any submission at our sole discretion.
You agree not to misuse the Site, including by: disrupting or overloading it; scraping or harvesting content or data at scale; introducing malicious code; misrepresenting your identity; submitting false, unlawful, defamatory, or infringing material; or using the Site in violation of any applicable law. We may restrict, suspend, or terminate access to the Site at any time, for any reason, without notice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. THE SITE IS OFFERED AS A FREE, BETA-STAGE SERVICE AND MAY BE INTERRUPTED, CHANGED, OR DISCONTINUED AT ANY TIME WITHOUT NOTICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) IN NO EVENT WILL SEES JOURNAL, ITS OWNER, OPERATORS, CONTRIBUTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, TIME, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE SITE (THE SITE IS FREE, SO ZERO) OR ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law. Any cause of action arising out of or related to the Site must be commenced within one (1) year after it accrues, or it is permanently barred, to the extent permitted by law.
You agree to defend, indemnify, and hold harmless Sees Journal and its owner, operators, and contributors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your submissions, or your violation of these Terms or of any law or third-party right.
These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us through the contact page and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Any dispute not resolved informally shall be resolved by binding arbitration in San Diego County, California, on an individual basis, except that either party may bring qualifying claims in small-claims court. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING, AND ANY RIGHT TO A JURY TRIAL. For any matter found not subject to arbitration, the state and federal courts located in San Diego County, California have exclusive jurisdiction, and you consent to personal jurisdiction and venue there.
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remainder will stay in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them freely. We may update these Terms at any time by posting the revised version here with a new “Last updated” date — please check back periodically.
